EU AI Act: how to skip the “AI-Generated” label
The law provides one exemption. Your AI-generated content doesn't need a label if both conditions are met:
Qualified human review
The substance of the text is examined, with fact-checking as a minimum. A quick proofread doesn't count.
Editorial responsibility
A person or organization answers for the content, with contact details available to the public.
1 + 2 = no label
If AI modifies the text again after my review, it must be reviewed again or labeled.
Whoever or whatever writes it,
your firm is responsible for every word.
Finance
MiFID II, PRIIPs, SFDR, MiCA, ESMA guidelines: financial content is regulated content. Every marketing communication must be fair, clear and not misleading: risks as visible as benefits, accurate performance figures, ESG claims backed up. AI can draft your factsheets, client letters or crypto offers in seconds, but it doesn't know these rules. It can overstate returns, hide risks or turn a fund into a “green” one without evidence. That's exactly what regulators sanction.
| Regulation | What it requires |
|---|---|
| MiFID II, Article 24(3) and Delegated Regulation (EU) 2017/565, Article 44 | All client information, including marketing, must be fair, clear and not misleading: accurate, balanced and understandable |
| PRIIPs Regulation (EU) 1286/2014, Articles 6 and 7 | Key Information Documents must be accurate, fair, clear and not misleading, in the local language, with faithful translations |
| Regulation (EU) 2019/1156, Article 4 | Fund marketing must be identifiable as such, present risks and rewards equally prominently, and be fair, clear and not misleading |
| MiCA, Article 7 (EU) | Crypto-asset marketing must be fair, clear and not misleading |
| AMF, Position-recommandation DOC-2011-24 (France) | Fund marketing must balance risks and benefits, match the prospectus, present past performance factually and use clear language |
| ACPR, Recommendation 2015-R-01 (France) | Life insurance advertising must use vocabulary the target audience understands, state risks, including capital loss, as clearly as benefits, and not overstate guarantees |
| AI Act, Article 50(4) (EU) | AI-generated text published to inform the public on matters of public interest must be disclosed as such, unless it has undergone human review and a person holds editorial responsibility |

Why human editing makes all the difference
Let's be honest: AI can write a book in a few hours, but it can't make anyone fall in love with it.
The Silent House
Chapter 7
Claire stared at the old house. A shiver ran down her spine. The night was dark and full of secrets, and the wind whispered secrets1 through the trees. She had never set foot in Paris2, so the letter made no sense. Clara3 pushed the door open. A shiver ran down her spine.4
1Repetition: no voice
2Contradicts ch. 3: she lived there!
3Claire? Name changed
4Already used, and a cliché
“The heroine's name changed halfway through, and I found critical contradictions. I gave up at Chapter 5. This book was likely written by AI. Don't buy!”
